1. Scope
​These Terms and Conditions (“Terms”) apply to all purchases made through the online shop operated by Art by Johanna Excell (the “Seller”, "I", "my", “we”, “our”, or “us”) via the website [www.johannaexcell.com] (the “Website”).
By placing an order, the customer (“Buyer”, “you”, or “your”) agrees to these Terms.

3. Products
- The shop offers original artworks, prints, ceramics, and related goods (the “Products”).
- Images of products and frames are for illustrative purposes only. Colors may vary slightly depending on screen settings.
- Original artworks are unique pieces; once sold, they cannot be reproduced in identical form.

4. Prices and Payment
- All prices are listed in Euro (€) and include statutory VAT where applicable.
- Shipping costs are shown separately before checkout.
- Payment is due immediately upon order and can be made via the payment methods offered at checkout.
- The Seller retains ownership of the Products until full payment is received.

5. Shipping and Delivery
- I ship within Germany, the EU, and internationally, unless otherwise specified.
- Delivery times vary by destination.
- Buyers are responsible for providing correct and complete delivery information.
- Import duties, customs charges, or local taxes outside of Germany are the responsibility of the Buyer.

 

Shipping Rates

Rates will be calculated at checkout. All parcels are tracked.

For oversized artworks such as large canvas paintings, higher international shipping rates may apply for destinations outside the EU. Please contact me for more information.

6. Right of Withdrawal (Consumers within the EU)

Effects of Withdrawal

If you withdraw, we will refund all payments (excluding delivery costs) within 14 days of receiving the returned goods. Refunds will be issued using the same payment method you used.

You must return the goods at your own cost and risk within 14 days of informing us. We will not cover return shipping costs.

If the returned goods show signs of use, damage, or are not properly packaged, we may reduce the refund accordingly.

7. Returns and Complaints

- Buyers are responsible for the cost of returning goods unless otherwise agreed.

- If a parcel is not accepted, not collected, or returned due to incorrect or incomplete delivery information provided by the Buyer, the Buyer is responsible for both the initial shipping costs and the costs of the return.

- Please inspect the Products upon delivery. If goods are damaged in transit, notify us immediately.

- For defects or incorrect deliveries, you are entitled to statutory warranty rights under German law (Sections 437 ff. BGB).

8. Intellectual Property

All artworks, designs, images, and content on this Website are protected by copyright and remain the property of Johanna Excell.
You may not reproduce, distribute, or commercially use any content without prior written consent.

9. Liability

- We are liable for intent and gross negligence as provided by German law.

- In cases of slight negligence, we are only liable for damages resulting from the breach of essential contractual obligations (cardinal duties).

- Liability for damages caused by injury to life, body, or health remains unaffected.

10. Governing Law and Jurisdiction

- These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

- If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.

- For business customers, the exclusive place of jurisdiction is Regensburg.

12. Taxes & VAT
All prices shown in the shop are final prices and include VAT (Mehrwertsteuer), where applicable.

- 7% VAT applies to original artworks (paintings, drawings, sculptures, and other unique works).

- 19% VAT applies to art prints and other products.

For orders outside the European Union, VAT is not charged.

Buyers may be responsible for customs duties or import taxes in their own country.
